1. Definitions

In these Terms and Conditions, the following words have the meanings given:

1.2 Customer, you or your means the individual, business or organisation that books or receives our waste collection or rubbish removal services.

1.4 Premises means the location where the Services are to be carried out, including any access routes, driveways, communal areas, gardens, outbuildings and internal spaces.

1.5 Waste means the items, materials and rubbish you ask us to remove as part of the Services, subject to the exclusions and restrictions in these Terms and Conditions and applicable law.

2. Scope of Services

2.1 We provide waste and rubbish removal services, including collection, loading, transportation and lawful disposal or recycling of general household, garden and light commercial waste, subject to these Terms and Conditions.

2.2 We reserve the right to refuse to remove any items that are unsafe, prohibited by law, or not as described at the time of booking. This may include hazardous, clinical, chemical, pressurised, or otherwise restricted waste streams.

2.3 We do not provide structural demolition services or works that fall under specialist licensed activities, unless expressly agreed in writing.

2.4 Our services are provided within our operational area, which includes Queen's Park and surrounding locations, as determined by us from time to time. Availability may vary.

3. Booking Process

3.1 You may request a booking by contacting us via telephone, email, or any booking facility we operate. All bookings are subject to acceptance and availability.

3.2 When you request a booking, you must provide accurate and complete information, including:

(a) your full name and contact details;
(b) the collection address and any access restrictions;
(c) a clear description of the waste to be collected, including approximate quantities and types of items; and
(d) any relevant information about parking, loading or property restrictions.

3.3 Any quotation we provide based on your description is an estimate only. Final pricing may change if, on arrival, the waste volume, type, or access conditions differ from what you initially described.

3.4 A booking is only confirmed when we have agreed a collection date and time window with you and, where required, received any applicable deposit or prepayment. We may send confirmation in writing or verbally.

3.5 You are responsible for ensuring that someone authorised is present at the Premises at the agreed time to grant access, confirm the items to be removed and sign any relevant documentation.

4. Access and Parking

4.1 You must ensure that we have safe and reasonable access to the Premises for our staff and vehicles at the agreed time. This includes arranging parking permits or visitor access where required.

4.2 If parking fees apply, these may be added to the final invoice unless agreed otherwise in advance.

4.3 If we are unable to carry out the Services due to lack of access, unsuitable parking, health and safety concerns, or other reasons beyond our control, we may treat the visit as a cancellation by you and charge a call-out or cancellation fee.

5. Pricing and Quotations

5.1 Our prices are typically based on the volume and weight of waste collected, the type of materials, labour involved and any additional charges such as congestion, parking or special handling fees.

5.2 Any quotation provided before arrival is an estimate only, based on the information you supply. On-site, our team will assess the waste and confirm the exact price before starting work.

5.3 If you decline the revised price after on-site assessment, we reserve the right to charge a reasonable call-out fee to cover our costs.

5.4 All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes, which will be indicated where relevant.

6. Payments

6.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing prior to the collection.

6.2 We accept payment by cash, card or other methods we may specify. We may require card details or a deposit to secure a booking.

6.3 For business customers with agreed account terms, payment must be made within the period stated on the invoice. If no period is stated, payment shall be due within 14 days of the invoice date.

6.4 If you fail to pay any amount owed to us on time, we reserve the right to:

(a) charge interest on overdue amounts at the maximum rate permitted by law; and
(b) suspend further services until all outstanding amounts are paid in full.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by contacting us directly.

7.2 If you cancel more than 24 hours before the scheduled collection time, any deposit paid may be refundable at our discretion, subject to any non-recoverable costs incurred by us.

7.3 If you cancel within 24 hours of the scheduled collection time, or fail to provide access at the time of collection, we may charge a cancellation or call-out fee to cover our costs.

7.4 If we need to cancel or reschedule your booking due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, staff illness or operational issues, we will notify you as soon as reasonably possible and offer an alternative date or a refund of any prepayment. We will not be liable for any indirect or consequential losses arising from such cancellation.

8. Customer Responsibilities

8.1 You are responsible for ensuring that:

(a) the waste to be collected is your property, or that you have the authority of the owner to arrange its removal;
(b) the items you present for collection are safe to handle and do not contain hazardous materials unless previously agreed;
(c) access routes are clear and safe for our staff and equipment; and
(d) you comply with any reasonable instructions given by our team on site.

8.2 You must not conceal hazardous, sharp or dangerous objects within general waste. We may refuse to handle such waste and may charge you for any additional measures required.

8.3 You must notify us in advance if any items are unusually heavy, awkward or require dismantling. Additional charges may apply for such items.

9. Waste Regulations and Environmental Compliance

9.1 We operate in accordance with applicable UK waste management and environmental regulations. We will transport and dispose of your waste only at authorised facilities.

9.2 By using our Services, you confirm that you understand your duty of care regarding waste and that you are transferring your waste to a registered carrier or operator.

9.3 We may issue or retain documentation relating to the transfer, transportation and disposal of waste and may provide details on request where legally required.

9.4 We aim to minimise landfill and will seek to reuse or recycle materials where reasonably practicable, but we do not guarantee that any particular item will be reused or recycled.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill when providing the Services. However, you acknowledge that waste removal and handling activities may involve some risk of minor damage, especially where access is restricted.

10.2 We will not be liable for:

(a) any pre-existing damage or defect at the Premises or to items to be removed;
(b) wear, scuffing or minor cosmetic marks that occur as a result of reasonable handling, where access is narrow or obstructed; or
(c) any indirect, consequential or economic loss, including loss of profit, loss of business or loss of opportunity.

10.3 Our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable for the specific booking in question, except where such limitation is not permitted by law.

10.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

10.5 You are responsible for removing or safeguarding any valuable, fragile or sentimental items that are not to be taken as waste. We will not be liable for any such items disposed of in error where they were not clearly separated or identified.

11. Property Damage and Complaints

11.1 If you believe that our staff have caused damage to your property, you must notify us as soon as reasonably possible, and in any event within 48 hours of the alleged incident.

11.2 We may ask for evidence, including photographs and a description of the circumstances. You must provide us with reasonable opportunity to inspect the damage before any repairs are undertaken.

11.3 If we accept responsibility for damage, we may choose to arrange repair, compensate you directly, or engage an independent contractor, at our discretion and subject to the limitations in these Terms and Conditions.

11.4 If you have a complaint about our Services, please contact us with full details. We will investigate and respond within a reasonable timeframe.

12. Insurance

12.1 We maintain insurance cover appropriate for the nature of our Services, including public liability insurance, subject to the terms, conditions and exclusions of the relevant policy.

12.2 Our insurance does not replace your own property or contents insurance. You should maintain adequate cover for your own property and possessions.

13. Force Majeure

13.1 We will not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to extreme weather, fire, flood, accidents, road closures, traffic congestion, industrial disputes, pandemics, acts of government or other emergency situations.

13.2 If a force majeure event occurs, we will notify you as soon as reasonably possible and will use reasonable efforts to resume the Services or offer an alternative arrangement.

14. Data Protection and Privacy

14.1 We may collect and process personal data about you in order to manage bookings, provide the Services, process payments and handle enquiries or complaints.

14.2 We will handle your personal information in accordance with applicable data protection laws and only retain it for as long as necessary for the purposes for which it was collected or as required by law.

14.3 You are responsible for ensuring that the contact details you provide are accurate and kept up to date so that we can communicate with you about your booking.

15. Variations to these Terms

15.1 We may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated version is published or supplied.

15.2 The Terms and Conditions in force at the time of your booking will apply to that booking, unless we agree otherwise in writing.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or confirmation of booking provided by us, constitute the entire agreement between you and us in relation to the Services and supersede all previous discussions, correspondence, negotiations or understandings.

18.2 You acknowledge that you have not relied on any statement, promise or representation that is not set out in these Terms and Conditions.
